This Privacy Policy sets forth our policy for collecting, storing, using and disclosing the personal information you provide to us. For purposes of our Privacy Policy, personal information means information about you, such as your name, address, e-mail address, phone number and other personally identifiable information that is not otherwise publicly available. Personal information also includes your usage of the Web site, when such information is supplied to or recorded by us in the course of transacting business with you or your use of the Web site. Personal information does not include information that we aggregate or is anonymized so that it does not identify a specific visitor or registered user.

2. Personal information may be disclosed to other registered users pursuant to the use of Profiles, the CV Posting System and our Internal Messaging System if you authorize the release of such personal information as described in the section below entitled “How You May Share Your Information”.
3. Personal information may be shared with a third party service provider to evaluate a registered user’s credit worthiness or to collect on a registered user’s account.
4. Personal information may be disclosed if required by law or ordered by a court or administrative agency.
5. Personal information may be disclosed to enforce the Terms and Conditions of Use, this Privacy Policy any applicable Rules or to enforce or protect our rights.
6. We reserve the right to sell, transfer and/or license the personal information you provide us to one or more third parties in the event we sell all or substantially all of the assets or equity of eMatchPhysicians.

How Your May Share Your Information

You may share your information, as well as your personal information, via the following ways on our Web site and via our Services:

Physicians may post Profiles of general information on our Web site. Profiles are not kept private and are searchable by all Hiring Organizations and Search Firms registered to use our Services. We encourage registered users not to include personal information in a Profile, rather registered users should only disclose personal information, including their contact information and curriculum vitae, to Hiring Organizations and Search Firms registered to use our Services via our Internal Messaging System and CV Posting System, respectively. Physicians may choose to post and share a curriculum vitae with our CV Posting System by posting a curriculum vitae to our Web site where indicated and checking the appropriate box for sharing the curriculum vitae. If you do not wish to share your curriculum vitae with a Hiring Organization or Search Firm registered to use our Services, do not post your curriculum vitae to our Web site or check the box which allows for your curriculum vitae to be shared. You may delete your curriculum vitae from our database. If you delete your curriculum vitae from our database, managers and recruiters who previously received your curriculum vitae through the CV Posting System may still have access to your curriculum vitae if they retained a copy for their files or databases. Physicians may also share their personal information via our Internal Messaging System in response to messages received from Hiring Organizations and Search Firms which have reviewed your Profile and/or curriculum vitae. We are not responsible for the sharing, retention, use or privacy of curriculum vitaes and other personal information shared by Physicians. We do not verify the credentials of Hiring Organizations or Search Firms registered to use our Services, nor do we confirm such registered users have positions available for Physicians. It is the sole responsibility of the Physician whether or not to grant access to their curriculum vitae by posting the curriculum vitae to our Web site and checking the appropriate box in our CV Posting System or sharing other personal information via our Services. It is also the sole responsibility of the Physician to evaluate offers made by Hiring Organizations and Search Firms.

Hiring Organizations and Search Firms may post Profiles of general information on our Web site which are not kept private and are searchable by Physicians registered to use our Services. Hiring Organizations and Search Firms may choose to use our Internal Messaging System to share contact and other additional and specific information about the Hiring Organization or Search Firm with Physicians through our Internal Messaging System. If you do not wish to share your contact and other additional and specific information about your Hiring Organization or Search Firm with Physicians registered to use our Services, do not include such information in your Profile. We are not responsible for the sharing, retention, use or privacy of personal information shared by Hiring Organizations and Search Firms. We do not verify the credentials of Physicians registered to use our Services, nor do we confirm the availability of such registered users for positions offered by or through Hiring Organizations or Search Firms. It is the sole responsibility of the Hiring Organization or Search Firm whether or not to grant access to their personal information via our Services and to evaluate the credentials and availability of a Physician for positions offered by or through the Hiring Organization or Search Firm.

Changing Personal Information

To the extent required by applicable law, you may request that we inform you about the personal information we maintain about you, and where appropriate, request that we update, correct, and/or suppress personal information about you that we maintain in our active database. We will make all required updates and changes within the time specified by applicable law, and where permitted, may charge an appropriate fee to cover the costs of responding to such request. Please remember, if you make such a request, we may not be able to provide you with the same quality and variety of services to which you are accustomed. Please direct your requests to the address and person listed below under the section “How to Contact Us.” To protect your confidentiality, we will only respond to the address or e-mail you provide to us in your request.

Exclusive Offers, Promotions, and Updates

From time to time, we may provide our registered users with exclusive offers, promotions and updates. You may unsubscribe from this Service at any time using the link provided on our e-mail messages.

CAN-SPAM Act Compliance

We are committed to being compliant with the “Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003″ (”CAN-SPAM Act”). All e-mails you receive from us are intended to fully comply with the CAN-SPAM Act.

We are not responsible for the terms and conditions of use, privacy policy, practices or the content of such third parties or third party Web sites. We encourage our visitors and registered users to be aware of when they leave our Web site and to read the terms and conditions of use and privacy policy of each Web site to which we may link that may collect personal information. If you have a question about the terms and conditions, of use privacy policy, practices or contents of a third party or a third party Web site, please contact the applicable third party directly. You acknowledge and agree that eMatchPhysicians shall not be a party to, or in any way responsible for, any transaction concerning products or services made available from third parties or for any content or information presented in connection with any products or services of third parties.

Amendments to This Privacy Policy

At our sole discretion and at any time, we may amend this Privacy Policy. You should review this Privacy Policy periodically to check for amendments. For your convenience, at the top of this Privacy Policy, we post the last date this Privacy Policy was updated. If our Privacy Policy is amended, the amended Privacy Policy will take effect immediately for all visitors and registered users of our Web site and Services; provided, however, all personal information collected during the effectiveness of a prior Privacy Policy will remain subject to the terms and conditions of such prior Privacy Policy until we receive affirmative acceptance of the application of the amended Privacy Policy to such previously collected personal information. Special Notification for California Residents - Your California Privacy Rights

Individual who are residents of California and have provided their personal information to us may request information regarding our disclosures, if any, of their personal information to third parties for direct marketing purposes. Such requests must include the reference “Request for California Privacy Information” in the subject line and in the body of the message and must include the e-mail address or mailing address, as applicable, for us to send our response. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted to us if not submitted pursuant to the terms of set forth above.
